LEGAL TERMS

Terms of Use

These terms govern access to and use of the HSESteward mobile application, web portals, website and related services.

Effective: 11 September 2026Contact: kibunja@hsesteward.com
Safety-critical use. HSESteward supports HSE work but is not a substitute for competent professional judgment, statutory duties, approved procedures, risk assessment, PTW authority, emergency response, rescue planning, isolation/energization authority or site-specific controls.

1. Acceptance

By creating an account, accepting an invitation, accessing an organization workspace or otherwise using HSESteward, you agree to these Terms and the Privacy Policy. If you use HSESteward for an organization, you represent that you are authorized to use the service within the scope granted to you.

2. Accounts, roles and organization administration

  • You must provide accurate account information and protect your credentials.
  • Organization administrators are responsible for assigning appropriate roles, project access and workforce permissions.
  • You must not share credentials, circumvent role controls, access another organization without authorization or attempt to obtain Platform Owner privileges through tenant tools.
  • An organization may suspend or remove workplace access in accordance with its relationship with the user.

3. Organization and user content

You and your organization remain responsible for the accuracy, lawfulness and appropriateness of data entered into HSESteward. This includes workforce information, safety reports, permits, photographs, documents, observations, comments and other uploaded or generated operational records.

You grant HSESteward the limited rights necessary to host, process, transmit, format, back up and otherwise handle submitted content solely to provide, secure and improve the service and to meet legal obligations.

4. Safety Intelligence and automated outputs

HSESteward may generate hazard, control, risk, HIPO/SIMOPS, precursor, trend, recommendation or other Safety Intelligence outputs. These are decision-support signals, not predictions, certifications, approvals or safety guarantees.

  • Human review remains required for safety-critical decisions.
  • Missing evidence does not automatically prove a control failed or that work is unsafe.
  • A low or moderate automated score does not prove that an activity is safe.
  • HSESteward does not authorize work, issue statutory permits, accept risk on behalf of an employer or replace a competent permit authority/HSE professional.

5. No emergency service

HSESteward is not an emergency communications or emergency dispatch service. In an emergency, follow the organization’s emergency plan and contact the appropriate emergency services or site response personnel.

6. Permitted and prohibited use

You may use HSESteward for legitimate HSE, workforce, project, document-control and operational safety purposes within your authorized scope. You must not:

  • Use the service unlawfully, deceptively or to harm another person.
  • Upload malware, infringing content or information you are not authorized to process.
  • Probe, reverse engineer, disrupt, overload or bypass security or tenant boundaries except where applicable law expressly permits.
  • Use Safety Intelligence as the sole basis for a safety-critical authorization or to conceal known unsafe conditions.

7. Service availability and changes

We may add, modify, suspend or discontinue features as the product evolves. Cloud, network, device or third-party service failures may temporarily affect availability. Where commercially reasonable, we will work to restore service, but uninterrupted availability is not guaranteed.

8. Trials, subscriptions and commercial arrangements

Some HSESteward features may be offered through trials, subscriptions, pilots or organization agreements. Commercial terms shown at purchase or agreed with an organization supplement these Terms. If a subscription is managed by an app store or another payment provider, cancellation may need to be completed through that provider.

9. Intellectual property

HSESteward software, branding, interface design, documentation and proprietary safety-intelligence architecture are owned by or licensed to the HSESteward operator. These Terms do not transfer ownership of HSESteward intellectual property to users or organizations.

10. Third-party services

HSESteward may rely on third-party infrastructure, authentication, storage, hosting, email, form, mapping, AI or other service providers. Their services may be governed by additional terms and privacy practices. HSESteward is not responsible for independent third-party services outside our control.

11. Suspension and termination

Access may be suspended or terminated for security risks, misuse, non-payment where applicable, violation of these Terms, organization-admin action, or legal requirements. Account/data deletion is handled separately under the Account & Data Deletion process.

12. Disclaimers and limitation

To the maximum extent permitted by applicable law, HSESteward is provided on an “as available” basis without warranties that automated outputs are complete, error-free or suitable as the sole basis for a safety-critical decision. Nothing in these Terms excludes liability that cannot legally be excluded.

13. Changes to these Terms

We may update these Terms as the service evolves. The current version and effective date will be posted here. Continued use after an update may constitute acceptance where permitted by law.
